Principles regarding entry and residence of EU citizens and members of their families to Poland in Polish legislation

Abstract

On 1 May 2004 the Act of 27 July 2002 on principles and conditions of entry and residence of EU citizens and members of their families on the territory of the Republic of Poland entered into force. An EU citizen could stay in Poland without any formalities for three months, then was obliged to apply for a temporary residence permit or residence permit, depending on the duration of one’s intended stay. The abovementioned act was replaced by Act on 14 July 2006 on entry into the territory of the Republic of Poland, residence and exit from its territory of EU citizens and members of their families, transposing the provisions of Directive 38/2004/EC into Polish legal system. The principal changes include: registration instead of residence permit/permanent residence permit, a new institution – the right of permanent residence and stronger protection against expulsion.
