Battling Member States’ Competence in the Field of Citizenship: The Case of Commission v Malta
Abstract
This article examines the division of competences between the European Union and its Member States in the context of nationality, while simultaneously exploring the boundaries between the protection of the Union’s values and the sovereignty of Member States in the exercise of their residual competences. It further analyses the potential of infringement proceedings as a mechanism for enforcing Union values, with particular attention paid to the role of EU values and the principle of sincere cooperation as legal bases for initiating such actions. The discussion is framed against the backdrop of the recent judgment in Commission v Malta.
